Terms of Service

These terms are a general SaaS service agreement for TikBreak. They are provided for product transparency and should not be treated as legal advice.

Acceptance of Terms

These Terms of Service govern your access to and use of TikBreak, including our website, applications, video analysis tools, script rewriting features, subscriptions, and related services.

By creating an account, purchasing a subscription, uploading content, or using the service, you agree to these terms. If you do not agree, you may not use TikBreak.

Accounts and Eligibility

You must provide accurate account information and keep your sign-in credentials secure. You are responsible for activity that occurs under your account.

You may use TikBreak only if you have the legal capacity to enter into these terms and are not prohibited from using the service under applicable law.

Use of the Service

TikBreak helps users analyze short-form product videos, extract creative structures, and generate original script drafts for ecommerce and content production workflows.

You agree not to misuse the service, interfere with its operation, attempt unauthorized access, reverse engineer protected systems, overload infrastructure, or use TikBreak for unlawful, harmful, deceptive, or abusive purposes.

User Content

You retain ownership of videos, links, prompts, product information, generated drafts, and other content you submit to TikBreak, subject to any rights held by third parties.

You grant TikBreak a limited license to host, process, transmit, display, and analyze your content as necessary to provide, maintain, secure, and improve the service.

You are responsible for ensuring that you have the rights and permissions needed to upload, submit, analyze, or reuse any content you provide.

Generated Output

TikBreak may generate analysis summaries, transcripts, timelines, creative breakdowns, and script drafts. Output may be incomplete, inaccurate, or unsuitable for a particular use.

You are responsible for reviewing generated output before relying on it, publishing it, sharing it with creators, or using it in commercial campaigns.

Subscriptions and Billing

Paid plans provide access to monthly usage limits and features described at checkout or in the product interface. Subscription billing is processed by our payment provider.

Unless otherwise stated, subscriptions renew automatically until canceled. You are responsible for applicable taxes, fees, and charges associated with your plan.

Plan limits, pricing, and included features may change over time. We will provide notice where required by law or where changes materially affect active subscriptions.

Cancellations and Refunds

You may cancel a paid subscription through the billing portal when available or by contacting us. Cancellation generally stops future renewal charges but does not automatically refund prior charges.

Refunds, if any, are provided at our discretion unless required by applicable law or stated in a separate written agreement.

Third-Party Services

TikBreak may rely on third-party services for authentication, hosting, storage, analytics, payment processing, email delivery, video processing, and AI model providers.

Third-party services may have their own terms and privacy practices. We are not responsible for third-party services that we do not control.

Intellectual Property

TikBreak and its software, branding, design, workflows, and service components are owned by TikBreak or its licensors and are protected by intellectual property laws.

These terms do not grant you ownership of TikBreak software or brand assets. You may not copy, modify, distribute, sell, or lease any part of the service except as permitted by these terms.

Service Availability

We aim to keep TikBreak reliable, but the service may be unavailable, delayed, limited, or changed due to maintenance, updates, infrastructure issues, third-party outages, security needs, or other reasons.

We may modify, suspend, or discontinue parts of the service at any time, subject to applicable law and any commitments made in a separate written agreement.

Disclaimers

TikBreak is provided on an as-is and as-available basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

TikBreak does not provide legal, financial, advertising, platform compliance, or professional advice. You are responsible for your business decisions and campaign use.

Limitation of Liability

To the maximum extent permitted by law, TikBreak will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption.

Where liability cannot be excluded, our liability will be limited to the amount you paid for the service during the three months before the event giving rise to the claim, unless applicable law requires otherwise.

Termination

You may stop using TikBreak at any time. We may suspend or terminate access if you violate these terms, create risk for the service or other users, fail to pay fees, or use the service unlawfully.

After termination, provisions that by their nature should survive will remain in effect, including ownership, payment obligations, disclaimers, limitations of liability, and dispute-related terms.

Changes to Terms

We may update these terms from time to time. If changes are material, we will provide reasonable notice through the service, by email, or by other appropriate means.

Your continued use of TikBreak after updated terms become effective means you accept the updated terms.
